The National Industrial Court has ordered the Academic Staff Union of Universities (ASUU), to call off its protracted strike action.
The Federal Government has filed an interlocutory injunction requesting that the court stops the strike that has been ongoing since February 14, 2022.
Justice Polycard Hamman ordered ASUU to retrain from continuing with the industrial action pending the determination of the suit.
What happened in court
While ruling on the application, Justice Hamman granted the interlocutory injunction sought by the federal government.
He held that the strike is detrimental to public university students who cannot afford to attend private tertiary institutions.
Consequently, he said, “The balance of convenience tilts in favour of the applicant.
“I hold that this application is meritorious and this application is granted.”
The court “Restrained ASUU, whether by themselves, members, agents, privies or howsoever called, from taking further steps and doing any act in continuance of the strike action pending the hearing and determination of the suit filed.”
Being a vacation judge, Justice Hamman directed that the case file be returned to the National Industrial court president for reassignment
