Thisday Reports that Pharma-Deko has been served a liquidation notice by the Financial Derivatives Company. See below;
An Ogun State-based firm, Pharma-Deko Plc, manufacturer of Sans Crème De Soda Drink and other pharmaceutical products, has been served with a fresh winding-up petition.
The winding-up petition filed before the Federal High Court in Abeokuta on October 7, was initiated against the company by a financial institution, Financial Derivatives Company Ltd, on account of indebtedness.
This came three years after the petitioner failed to pursue an order of advertisement earlier granted by Justice Rita Ofili-Ajumogobia, who has now been transferred to the Lagos Division of the Federal High Court.
The petition, contained FHC/AB/CS/24/2010, was filed on the strength of Order 26 Rules 1 and 2 of the Federal High Court (Civil Procedure) Rules 2009 and Rule 19 of the Company Winding Up Rules, 2001.
The earlier proceeding filed against the company on June 24, 2010 was stalled after the court had granted an ex-parte application by Financial Derivatives seeking an order of court for the advertisement of the petition.
Financial Derivatives, through its counsel, Mr. Kunle Ogunba (SAN), alleged in the fresh petition that the respondent had exhibited nonchalance towards off-setting its indebtedness.
